System – means hardware and software utilised by my mhealth Limited to provide the service. Either made available through the internet or applications or websites that you access through your devices.

2 TERMS OF USE
2.1 You may use this system providing you agree to these terms of use. If you do not agree to these terms of use, you must not use this system. If you use the system, you will be deemed to have accepted these terms. We reserve the right to change these terms of use by posting any changes on the system. The new terms will be effective immediately they are posted.
3 RELIANCE ON INFORMATION
We aim to ensure that the information published on this system is accurate and consistent with current knowledge and practice in the field of medicine. However, medical knowledge and practice are constantly evolving and individual cases may require specific advice that cannot be addressed through this system. Accordingly, this system is provided for information only. It is not intended to replace a consultation with an appropriately qualified health professional. We cannot guarantee that information provided by us through this system will meet your health or medical requirements. If you are concerned about your health, please contact your GP or appropriate health professional.
4 WARRANTIES AND LIMITATION OF LIABILITY
4.1 We do not give any warranty, condition, guarantee or representation, express or implied, relating to information contained on this system or to any system to which it is linked.
4.2 Further, we do not warrant that our system will be free of error or that the system is free of computer viruses or other harmful applications.
4.3 You acknowledge and agree that my mhealth Limited and its employees will not be responsible for any claims, losses or damages (whether direct or indirect) arising out of or relating to the misuse of or inappropriate reliance on the contents or advice contained within this system.
4.4 We shall not be liable to you, regardless of the form of action, whether in contract, tort (including negligence and breach of statutory duty), strict liability, or otherwise whatsoever, for any loss of profit, business, contracts, or revenues, or for any special, indirect or consequential damage of any nature whatsoever arising directly or indirectly out of your use of our system.
4.5 Nothing in this clause 4 shall limit our liability for the injury or death of any person caused by our negligence (for which no limit applies within the jurisdiction of England and Wales), for fraud, or for any other liability which cannot be excluded by law.
5 TERMS APPLICABLE TO REGISTRATION ON THE SYSTEM
5.1 You must at all times keep your username and password confidential and you must notify us immediately of any unauthorised use of your username or password, or of any breach of security known to you.
5.2 We can require you to change your username and/or password for security reasons at any time. If you wish to change your username and/or password you may contact us and do so.
5.3 You are responsible for all activities which occur under your username and password, save where such activities occur as a result of our negligence or fault.
6 CHANGING INFORMATION ON THE SYSTEM
6.1 Where you have elected to register your details on our system, we reserve the right to delete your details and any information that you have provided from the System for any reason we consider to be appropriate, including (without limitation) where we believe the details to be out of date. Where possible, we will contact you to let you know that we have removed (or that we intend to remove) your details from the System.
6.2 If you wish to change or remove your details from the System, you may do this at any time by:
6.2.1 emailing the required changes to us at info@mymhealth.com;
6.2.2 writing to us at my mhealth Limited, 8 Trinity, 161 Old Christchurch Road, BOURNEMOUTH, BH1 1JU; or
6.2.3 by logging into your account and changing your details online (if you entered your details via the system).
7 USE OF MATERIAL
We recognise that when you obtain access to our system, your computer downloads a copy of the material on this system. By obtaining access to our system, you agree that you will use the material for your personal use only. You agree not to use the material for any commercial purpose.
8 LINKS TO THIRD PARTY SITES
We may, from time to time, let you leave the site to linked sites. The linked sites are not under our control and we explicitly state that we are not responsible for the contents of any linked site. The links are provided for your convenience and any such link does not imply endorsement by us of the site or of any association with the operators of the site.
9 OUR USE OF YOUR PERSONAL INFORMATION
9.1 If you submit personal information to us through this system, it will be used in accordance with our privacy policy.
9.2 The internet is not a secure medium for communication. We cannot guarantee that any information you submit to us through our system or by email will arrive safely or be secure from interception by third parties.
10 SEVERANCE
If any term is held to be invalid, unlawful or unenforceable, it shall not affect the enforceability of any of the remaining terms.
11 RIGHT OF CANCELLATION
If the service provided by the System is not of satisfactory quality, upon your request you may have your purchase cancelled and obtain a refund provided that you do so within 30 days of the original purchase. my mhealth Limited will not be able to offer any refunds for accounts that are deleted or suspended due to a violation of the Terms and Conditions or Privacy Policy.
12 LAW
These terms of use shall be governed and construed in accordance with English law and be subject to the exclusive jurisdiction of the English courts.
